Terms & Conditions

All Products are sold subject to the Terms and Conditions set out below. Certain words and phrases have special meanings when used in these Terms and Conditions - these words and phrases are defined in the 'Definitions' section towards the end of these Terms and Conditions.

Conditions of Sale

Please note that any acceptance of an order placed from outside the United Kingdom is not valid. Clicking on "Check Out" on the "Shopping Cart Page", means you offer to buy the Goods at the prices indicated including any delivery charges that apply to your purchase. All orders will be subject to these conditions.

Should your order be accepted, you will be notified of this soon after you submit your order by clicking "Complete Purchase". As the confirmation is sent to you automatically, an error may have been made of which we are not aware despite our best efforts. Because of this, we retain the right to cancel the order as set out under the "Cancellation" heading.

Acceptance of Order

Your order becomes binding as soon as we have accepted same, subject to your rights of cancellation.

Your order will be accepted as soon as we have confirmed your order. Our acceptance of your order is conditional on the availability of the Products you have ordered. If any of the products you have ordered are unavailable, or should events occur beyond our reasonable control, we reserve the right to cancel your order. In such circumstances we shall let you know as soon as possible.

Made to Measure Products

The Products you order will be made specifically to your order, in accordance with the instructions and specifications you have given us.

It is your responsibility to check all details and aspects of your order are correct, and suitable for your requirements, including measurements, dimensions, Product features, access and delivery.

Hanging and Installation

We can offer a full hanging service on our larger frames. Please call 01303 261095 for details of this service. We strongly advise when considering hanging your mirror yourself that you consult a professional. All fixings supplied with your mirror are a suggestion only and Ellingham Glass Limited cannot be held liable for any damage caused to you, others or property during the installation and therefore after installation of your mirror.

Cancellations, Returns and Refunds

Cancellations, returns and refunds are subject to the following conditions.

Standard Ready Made Products

You have the right to cancel your order:

 

  1. At any time before you receive the selected mirror you ordered by contacting us on 01303 261095. If these Products have already been assigned or dispatched when you contact us, you will be required to return them upon delivery as detailed below.
  2. Up to eight days after you have received the mirror you ordered, by contacting us on 01303 261095 within that eight day period and we will refund any payment that you have already made. You are required to return any such cancelled Products to us within seven days of the date of cancellation. Where you are returning Products, you should return them to us by one of the methods set out below, with proof of purchase (receipt or dispatch note), unused and in the condition in which you received them.

 

If you amend or cancel your order more than 48 hours after you placed it, we reserve the right to charge you any costs we will incur in relation to your order, however this shall not be more than 25% of the value of the products in question.

Please note delivery charges relating to your original order and subsequent return will not be credited or refunded.

Upon receipt of the goods, and subject to them being in satisfactory and resalable condition, you will then be entitled to a refund from us, which will be paid as soon as possible, but in any event within 30 [thirty] days.

Defective / Damaged Mirrors or Frames

If you believe any of our Products to be of an unsatisfactory quality please immediately contact us on 01303 261095 and treat your Product with the utmost care. Nothing mentioned in these Terms and Conditions affects your statutory rights in the unlikely event that the goods do not meet a standard required by law.

Damaged Packages

If you receive damaged products, note that fact on the delivery note, even before you open the packaging to examine the contents. Make sure that you sign for it as 'damaged package -', or something similar, so as to warn the carrier that a claim may be forthcoming. Please remember that you are allowed, by the carrier, a reasonable amount of time to examine the contents of your package on delivery should you suspect damage has occurred in transit.

To cover the circumstances, please contact us by email or telephone with as much detail of the damage or loss as you can provide as soon after delivery as possible, so that the Company can arrange for the dispatch of replacement products and follow up the difficulty with the carriers. Please do not return damaged products to the company unless or until requested to do so as this may incur additional costs unnecessarily.

We will happily arrange an exchange, credit or refund of the full purchase price paid for the products, once we have examined them, but the cost of the delivery cannot be refunded. Please note that the refunds will normally be made using the same method as the original payment i.e. a credit or debit card.

Manufacturing Faults

Any product with a manufacturing fault will be replaced in accordance with the manufacturers guarantee on a like for like basis only. No credit will be given and no alternative product will be supplied. Faulty products must be returned in suitable protective packaging by Recorded Delivery or some other traceable method.

We reserve the right to reject any "faulty" product if we consider the complaint to be unreasonable, unjustified, or of the customer's negligence or making.

These guarantees do not cover fair wear and tear; neglect; abuse or misuse of your goods; loss or damage through whatever causation, e.g. fire, smoke, sunlight, weather, rusting, corrosion, infestation via animals or boring insects, theft, or explosion; accidental damage or consequential loss, etc. The supplier?s liability is restricted to value of replacement goods only and we will not be held liable for any consequential losses.

We will not be liable for any consequential loss or damage arising out of defective, damaged or wrongly delivered goods over and above the value of those goods. This does not affect your statutory rights.

Essential Checks Before Ordering

It is your responsibility to ensure that the mirror/mirrors you have ordered will fit into your home, and that there is sufficient access for our delivery lorry to reach the delivery address.

Essential Checks on Delivery

Please check your Products carefully and report any defects immediately on delivery.

Delivery Charges and Carriers

Delivery charges apply to the UK mainland only.

Delivery is normally via our selected carrier who will deliver to your door only as they are not insured to carry heavy mirrors up stairs, etc., they will usually be delighted to assist beyond the doorstep but are under no obligation to do so.

Your item is fully insured until it reaches the delivery property at this point the insurance liability falls upon the recipient. To ensure the delivery prices are kept low the drivers will not undertake additional tasks such as removing doors, window frames or rearranging furniture. Deliveries requiring special arrangements can sometimes be made but will be at an additional cost to your self.

Important Delivery Information

If you are unavailable or unwilling to take delivery of your order on two occasions after having agreed delivery dates with Customer Services, we will start to charge you subsequent deliveries.

Delivery Times

Delivery dates and weeks are not guaranteed but we will do our utmost to ensure goods are delivered within the stated date or soon afterwards.

We shall not be responsible for delays or failures in delivery caused because we cannot gain access to the delivery address on the agreed delivery date or because of other circumstances beyond our reasonable control.

We will not be liable for any consequential loss or damage arising out of the late or non-delivery of goods, and time and date of delivery is not of the essence of this agreement.

An adult must be available at the address to check the products, sign and acknowledge receipt in a safe and satisfactory condition.

If no one is available to accept delivery at the delivery address, we shall keep your Products and contact you to rearrange delivery unless other prior arrangements have been made. We charge 100% redelivery charge for all items.

Measurements supplied by you the customer

We rely on the accuracy of your measurements when ordering mirrors to fit a given space/dimension. We do not accept responsibility for any inaccurate measurements provided by you

Colours, Descriptions and Unique Features

Every effort is made to ensure that the Products we supply correspond as closely as possible to the images shown on line, but they might not be exactly the same. We regret that no responsibility can be accepted for these slight variations which all add to the unique features of our Products including but not limited to the following:

 

  1. References to ?gold? and ?silver? are, unless stated otherwise, references to the respective colours and do not mean that the frames are made from precious metal.
  2. On certain leather/suede finishes there may be shade variations, and the small blemishes found in the leather are a unique characteristic of a natural material and not a defect or weakness. Scratches and marks may occur through everyday use, these will age over time and add to the distinguishing features of this classic Product.
  3. On Frames many of our Products are individually hand finished and therefore there will be some slight differences between batches.
  4. Some of our Products are hand finished to look distressed. Distressing will vary from Product to Product and is a unique design feature and not a defect.
  5. All measurements are approximate, please allow +/- 10mm variance on sizes stated.
  6. Every effort is made to ensure the accuracy of colour reproduction, colour may very in accordance the settings of your monitor, software, or printer.

 

Prices

Every effort is made to ensure that the prices shown are correct at the time of publication including VAT where applicable. If an error has been made, we or you may cancel the order in relation to some or all of the Goods as indicated under our cancellation agreement.

It may be necessary to raise our prices in certain circumstances, e.g. if component costs increase or currency conversions change materially.

The price for the Products you order will be the price confirmed to you when or soon after you place your order. If this varies from any quoted price, we will contact you to check that you still wish to proceed.

All prices are in £ Sterling and include VAT but exclude delivery charges where they apply.

Payment Methods

You may pay by Debit Card, Visa and Master Card or by cheque made payable to Ellingham Glass Limited.

Errors

Every effort is made to ensure that all the information provided on this website is correct at the time of going online.

General

No order is binding on you or Ellingham Glass Limeted until we have accepted it. You will own the items we supply you from the moment they are put in the hands of the postal service, or with our carriers, or on payment in full of the price of the Goods and any delivery charge, whichever is later. These terms and conditions cannot be varied by you or us unless made in writing and signed by both parties.

If any provision contained in these Terms and Conditions is considered by any court or regulatory authority to be unfair, invalid or unenforceable, that provision will be considered deleted from these Terms and Conditions without affecting the other provisions.

The law of England and Wales governs these Terms and Conditions and all disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Definitions

In these Conditions:

  • 'Goods' means the goods in your shopping basket at the time of ordering. It includes any service that comes with any goods;
  • 'Cancellation Period' means the period of eight days from the date of receipt of goods ordered by Distance Communication during which you are entitled to cancel your purchase order;
  • 'Distance Communication' means purchases exclusively made via telephone, fax, mail order and/or our website;
  • 'Made-To-Measure' means Products altered or made to measurements provided by you such as external fame dimensions;
  • 'Product or Products' means Ellingham Glass Limited and our suppliers? good(s);
  • 'we', 'us', 'our' means Ellingham Glass Limited;
  • 'you', 'your' means one of our customers.

We have used reasonable care and skill in compiling the content of our website but make no warranty, express or implied, as to the nature or accuracy of any material on the website and cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon information contained within this website. Due to constraints in digital reproduction, differences in web browsers and monitor displays, We will not be liable for any consequential loss or damage arising should you rely on the accuracy of the digitally reproduced images contained within this site.

Force Majeure

Neither you nor Ellingham Glass Limited will be held liable for any failure to perform any obligation to the other due to causes beyond your or our respective reasonable control.

Applicable Law

We control and operate the web site from our business premises within England. Accordingly the laws of England and Wales govern claims relating to, including the use of, this web site and the materials contained therein. If you choose to access our web site from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between Ellingham Glass Limited and you the laws of England and Wales will apply at all times.
